TERMS, CONDITIONS AND POLICIES
Note: Driver pick-up time is approximate. Driver may arrive as early as the "end" of the "Rental Period" or as late as 11 pm to pick up the equipment. Customer is responsible for all the equipment until it is picked up by our driver. Same Driver will return for unit; if not, call office immediately!
1. Safety/Operating Instructions: In addition to the information set forth in this agreement, customer acknowledges that there is safety and operation instructions on the equipment delivered and agrees to read those instructions and operate the equipment, or allow the equipment to be operated or used, in accordance with those instructions. Customer further acknowledges and understands that The O Zone has not agreed to nor have they provided any operators with this rented equipment, and that customer, is solely responsible for the correct and safe operation of this equipment. Customer understands that children's safety depends upon customer providing AT ALL TIMES correct operation of and the use of the equipment, especially the INFLATABLE Unit. Customer further agrees to keep all equipment away from swimming pool(s) and customer understands and agrees that they will not operate any electrical equipment near water. By entering into this agreement, Customer acknowledges that there is a risk of injury or damage arising out of the use of this equipment, and to assume any and all risk of injury or damage. In particular, customer will not permit the equipment to be operated by anyone who is not fully qualified and who had not received instruction from customer on the safe operation and use of the equipment, nor shall customer allow any person to use or operate the Equipment when it is in need of repair or when it is in an unsafe condition or situation.
2. General Release/Indemnity/Hold Harmless: Customer will take all necessary precautions regarding the item rented, and protect all persons and property from injury or damage. Customer acknowledge that they are in charge of the operation, installation and use of the Rental Equipment, and are fully responsible for its safe operation and installation as well as the return of the Rental Equipment in good working order. Customer acknowledges and agrees that Lessor is not responsible for any injury occurring to Customer, or any guests of Customer or to any other persons using the Rental Equipment, or to any claims by any other person(s) injured by or on account of the Rental Equipment, while the equipment is in the possession of the Customer. Customer agrees to defend, indemnity and hold harmless Lessor from and against any and all liability, claims judgments, attorneys fees, and costs of every kind and nature, including, but not limited to, injuries or death to persons and/or damage to property, whether or not such claimant is known or unknown to Customer, which arises out of these, maintenance, installation, operation, instruction, possession, of rental or any of the Rental Equipment, however caused, but with such claim arising while or such injury or damage occurring while such Rental Equipment is in the actual or constructive possession of Customer.
These General Release, Indemnity and Hold Harmless provisions apply to, but are not limited to, any injury, death, damage, claim or liability which may arise on account of the negligence, whether active or passive, of Lessor or Lessor's suppliers, agents, employees, contractors, drivers or installers. Customer further acknowledges that Lessor is not a food supplier or handler, and that any food related items, such as popcorn, which may be supplied with the Rental Equipment, is a straight pass through by Lessor to Customer. Since this additional service is provided to Customer as a courtesy by Lessor, and so long as Lessor advises Customer in writing, after Customer requests, with the name and address of the supplier of any specific item, Customer specifically agrees to waive and release, Indemnity and hold lessor harmless from and against any and all claims of whatever kind or nature arising out of or involved with the food items supplied.
I HAVE READ AND UNDERSTAND THE TERMS, CONDITIONS AND POLICIES OF THIS AGREEMENT, INCLUDING THE ADDITIONAL, TERMS, CONDITIONS AND POLICIES, AND AGREE TO BE BOUND BY THEM. I FURTHER WARRANT AND REPRESENT THAT I AM EITHER THE CUSTOMER NAMED ABOVE, OR AM AUTHORIZED AND EMPOWERED TO ACCEPT DELIVERY OF THE EQUIPMENT AND TO SIGN THIS AGREEMENT ON THEIR BEHALF AND AS THEIR AGENT. FURTHERMORE, I AGREE THAT I AM ALSO BINDING MYSELF PERSONALLY AS AN ADDITIONAL PARTY TO ALL OF THE TERMS, CONDITIONS AND POLICIES OF THIS AGREEMENT.
(ADULT SUPERVISION REQUIRED AT ALL TIMES)
1. Payment Policy:
a - All money for rentals is due no less than 1 week (7 days) before date of rental. We require a $50 deposit to secure your date and the unit you are requesting at time of booking. The full amount is due no less than 1 week (7 days) before date of rental.
b - Deposit and/or full payment will be refunded if there is inclement weather. (Inclement weather is based on Our Inclement Weather Policy.)
c - The deposit will not be refunded if there is a cancellation due to lack of funds or the renter cancels for any reason. If the renter cancels within 1 week (7 days) of rental the deposit and/or full payment will not be refunded for any reason.
2. Cancellation Due to Lack of Funds
a - If funds are not received within 1 week (7 days) of rental date (unless otherwise arranged by the renter and The O Zone) the unit will not be delivered and The O Zone has the right to refuse to deliver or set up the unit until payment is secured.
b - The O Zone has the right to pick the unit up early if, for any reason, payment is not secured. Including but not limited to; credit card denial, bad check or incomplete payment.
3-1. Inclement Weather Policy
a - If there is heavy rain we will not deliver or set the unit up on location.
b - If there is light rain and the forecast is calling for clearing skies the unit will be delivered and set up on location. The unit is NOT to be used in the rain. It is required that the rain has stopped and the unit is wiped down before it can be used.
c - If there are high winds, higher then 15 MPH, the unit can be set up but not inflated until the wind settles below 15 MPH. If the wind starts to pick up, the unit must be deflated and you must wait to inflate the unit until the wind settles down.
d - If the temperate drops below 42 degrees the unit will not be delivered. If the temperature drops below 42 degrees while the unit is set up on location the renters are required to deflate the unit and not inflate the unit until the temperature rises above 42 degrees.
4. Rescheduling Policy
a - If a rental is cancelled due to inclement weather, The O Zone will do everything in their power to reschedule, for an alternate date, the unit that the renter has originally scheduled. If the unit can not be secured for the alternate date, another unit, if available, will be provided.
b - If the unit has been used for more than 2 hours at the rental location this will be considered a full rental day and will not be rescheduled.
c - If the unit has not been used at the rental location for more than 2 hours, that unit will be provided, if available, at no extra charge for a reschedule date. If that exact unit is not available then a replacement unit will be provided at no extra charge.
Lessor agrees to be bound by the terms, conditions and policies of this agreement.
